In 2019, a group of students, working on a group project on climate change and international law, began to campaign for the matter to be brought to the International Court of Justice. The government of Vanuatu was persuaded to bring it to the United Nations, and was joined by many other states, resulting in a unanimously supported resolution at the UN General Assembly in 2023 to request an advisory opinion from the ICJ on the legal obligations of states and the legal consequences of failing to meet those obligations. On July 23rd, the ICJ published their ruling. Amongst other findings,:

- The Paris Agreement's 1.5°C temperature target is legally binding for all states that have ratified the Agreement

- Customary law requires that all states, in particular the largest emitters, must take ambitious mitigation measures in line with the best available science

- States with high greenhouse gas emissions and/or heavy dependence on fossil fuel productions can be subject to legal action, with the possibility of being required to provide reparation, restoration and compensation to victims of climate change impacts.

In this episode, Mark is in conversation with Mitchell Beer, editor of the Energy Mix, about the ICJ's verdict and its implications.

Mark explores three recent reports:

The Canada Electricity Advisory Council produced detailed recommendations for how the electricity sector can lead the transition to "net zero" carbon. In line with an increasing consensus, they call for serious pursuit of energy efficiency, a rapid rollout of renewables, and a significant expansion of the capacity for interprovincial trading.
Saskatchewan's provincial auditor has exposed serious weaknesses in the management and operation of the provincially-run output-based scheme for carbon pricing of heavy industry. She calls for genuine transparency, and questions why there had been no use of the technology fund which is supposed to enable corporations to reduce their emissions intensity.
The Institute for Energy Economics and Financial Analysis has looked at the assertions made in support of small modular nuclear reactors and shown the weakness of those claims.

Five years after it was finalised, Saskatoon's GHG emissions reduction policy is at a crossroads. With the council under financial pressure, there have been calls on the council to reduce funding or delay projects identified under the Low Emissions Community Program. However, some projects are already behind schedule, and, while reductions have been achieved, the ability to sustain and accelerate them towards net-zero by 2050 is uncertain.

In this context, Mayor Charlie Clark and Councillors Serina Gersher and Mairin Loewen (council leads on environmental sustainability) met with a coaltion of climate-concerned groups at the beginning of February. In this interview with Mark, two attendees, Glenn Wright and Caylin Lee, talk about the presentations at the meeting and their impressions.

At the time of recording, the COP28 climate summit was in turmoil, with both vulnerable low-income states and much of the industrialised world finding COP president Sultan Al Jaber's draft agreement to be unacceptable. But Al Jaber isn't the only leader seeking to impose the agenda of the oil and gas industry on the world at a time of climate emergency: Saskatchewan's own Scott Moe has made a number of inaccurate and misleading public comments that need to be corrected. Mark briefly attempts to do so, before replaying an interview with Tzeporah Berman on one of the most positive climate initiatives to have emerged in recent years, the Fossil Fuel Non-Proliferation Treaty proposal, now supported by 12 nation states, the WHO, the European Parliament, the state of California, and numerous scientists and civil society leaders.

With Gaza under siege and intense bombardment, humanitarian organisations,UN agencies and many others have been calling for a ceasefire. Much as the people of Gaza need that, there is a longer history of suffering, in which environmental and climate impacts are closely intertwined with deprivation of basic human rights under occupation. So this week we are repeating an interview we did in 2018 with Suha Jarrar, then a researcher with Palestinian human rights organisation Al-Haq, with a focus on womens' rights and climate. Sadly, Suha died at the age of 31 in 2021, so in repeating this interview we are both remembering her and amplifying what she had to say about the context in which the present war is happening.

Since the 2015 Paris agreement, the UN Environment Programme has been publishing annually the Emissions Gap Report: an annual assessment of progress towards emissions reduction and comparison of policies with what is needed to achieve the Paris goals.

For the last few years that report has been complemented by two other reports, which are the subject of this episode.

The Adaptation Gap Report looks at the shortfall in financial support for people worldwide who need funds to adapt to the existing and future impacts of climate change on their lives, their homelands and their livelihoods.

The Production Gap Report addresses the plans for fossil fuel extraction and compares the numbers to the levels consistent with the Paris goals.

On 5th April 2023, the Royal Bank of Canada held its AGM in Saskatoon. On the agenda were a number of motions calling for an end to the bank's heavy financing of fossil fuel expansion; Indigenous leaders including We'tsue'ten chief Na'moks arrived with proxy votes to speak to and support those motions. In the event, however, the chair of the meeting shunted proxy voters into a side room connected through a screen to the main meeting, and cut the microphone when Chief Na'moks tried to put his case.

However, he was free to speak on the previous evening, at an Indigenous-organised panel presentation. This week's episode covers Chief Na'moks' speech to that meeting, and also the message from Roishetta Ozane, from Texas Campaign for the Environment, whose mainly Black community has been negatively impacted for decades by the oil industry.

In this episode Hayley chats with Gary Carriere of Cumberland House.At 10,000km² the Saskatchewan River Delta is the largest such system in North America and a hidden gem. 80% of the Delta is wetlands that serve as critical breeding and migratory habitat for birds and wildlife, and shelter protected species such as the Lake Sturgeon. However, human-induced changes have profoundly altered the Delta from natural conditions. Dams and increased water demand along the Saskatchewan River change the volume and timing of river flows and restrict nutrients to the area which has led to a decline in ecosystem health and animal populations. As a consequence, people in the area can no longer depend on the traditional activities that once supported their livelihood. Hayley talked with Gary to learn more about the importance of the area and the changes he has observed over his lifetime.
