His death was initially ruled a hit and run, and although an investigation was underway, it went cold in 2016. Many believed it to be a Murdaugh cover-up as no concrete evidence pointed to a hit and run. Smith's case was reopened in 2021, and with the attention surrounding the Murdaugh Netfilix Special, his family is hopeful to get some answers. Susanne Andrews, a family friend and creator of "Standing for Stephen," is advocating tirelessly to get a hate crime bill (Smith was openly gay) passed in South Carolina, which is one of the only two states in the US that doesn't have a hate crime bill at a state level.
