Every new president has to appoint about 4,000 people to various government positions. The Senate has to confirm about 1,200 of those appointments. This number has grown, and the efficiency of administrations and the Senate has decreased over time. It’s a problem that was identified in stark terms by the 9/11 commission report in 2004. The 9/11 commission identified the lack of key national security officials in place as one of America’s vulnerabilities.

On September 11, 2001, only 57% of key national security appointments were confirmed.

On September 11, 2021, only about 25% of key national security appointments were confirmed.

What’s going on with the debt ceiling crisis?

• From NY Mag: “Congressional Republicans are on the brink of throwing the US economy into a brutal recession, triggering a global financial panic, and vandalizing the foundations of American geopolitical power — all for the sake of gaining fodder for disingenuous midterm attack ads. Congressional Democrats, meanwhile, are on the brink of doing the very same things, just to preempt those 30-second spots (and thus force Republicans to hit them with slightly different disingenuous ads). This may sound like the synopsis of some tedious, Aaron Sorkin - helmed political satire. But it’s a straightforward description of the debt-ceiling standoff in Washington, DC today.”

How does our debt work today?

• First, let’s just think about how the United States of America, as a country, spends money. Congress has to pass laws that authorize the government getting money (through taxes) and spending it.
• Congress also has to vote on whether to allow the Treasury to borrow funds needed to cover the gap between revenue and spending. That’s not a constitutional requirement. It’s one that Congress wrote into our law — Congress set a limit by statute on how much debt the government can hold, and so Congress has to raise the debt ceiling whenever the spending that it, Congress, authorized, exceeds this limit. This originated from convenience. Previously, Congress had to vote every time the government needed to issue debt. In 1917, Congress passed a debt ceiling to make it easier for Treasury to issue debt without getting Congress’s permission. Setting some limitation on that power is supposed to preserve the power of the purse stays with Congress instead of shifting to the Treasury Department. Since 1960, Congress has voted to raise the debt ceiling 80 times.
• Let’s think about what it means for the US government to borrow money. It doesn’t take out a loan the way that you or I might. It issues debt — meaning, it sells paper. This paper can take lots of forms — bills, bonds, notes — but it all amounts to an IOU from the United States government. And people buy that paper from the Government because an IOU from the US government to pay back an amount of money with interest is seen as the safest, most stable investment in the world. The US Bureau of Fiscal Service keeps records of who bought this paper and handles paying people back on the appropriate schedule.
• If the government can’t keep issuing debt in order to bring in the cash it needs to operate normally — including making scheduled payments on those IOUs, which is what we mean by “default”, a whole bunch of bad things could happen:
• The payments the government normally makes to citizens could stop. Think social security, the child tax credit, payments to military members and veterans and postal workers and federal employees
• The government’s credit could be downgraded, which would probably cause interest rates to go up, which would make it more expensive for everyone else to borrow money. If the risk of holding IOUs from the US government has gone up, the risk of holding IOUs from anyone else would probably go up, too. It might also mean that everyone has trouble borrowing money for a while — Wall Street’s trading systems aren’t really set up to sort out US treasuries that the government has defaulted on from those it hasn’t, so all of the buying and selling that happens of those securities could come to a halt, which could bring a lot of other lending to a halt. It helps me to think about this a little bit like the supply chain — when one piece shifts, everything around it shifts, too—to different degrees.
• Confidence would probably fall, which could result in problems in the stock market, which hurts 401ks and other investments.
• It’s important to remember that a lot of US debt is held by American citizens. I grew up hearing about the national debt as like a loan that China gave us and the conversation always sounded like China could come repossess our country like a car. That’s not how it works. The majority of US debt is held by, wait for it, the Social Security Trust fund. AKA our retirement funds, AKA taxpayers. Remember how we talked about accounting games with social security meaning that the cash we pay in doesn’t get paid out directly? Mmhmmm. And there are other government agencies who have borrowed money from each other and hold onto government-backed securities.
• Of the debt held outside the US government, foreign governments own only 1/3 of it. The rest is US banks and investors, the Federal Reserve, state and local governments, mutual funds, pension funds, insurance companies, and savings bonds. Of the 28.4 ish trillion dollars of debt issued right now, China only owns 1.06 trillion. That’s not nothing, but it’s not the nightmare scenario that I grew up hearing about. Japan actually owns more of our debt than China.
• The government could stop funding FEMA and public health initiatives around Covid 19 and programs that provide food for kids.
• As with all things that involve economics, we really don’t know what will happen because it all ultimately depends on human behavior, but people who study these things tend to agree with the New York Magazine description I read at the beginning — that this would be very, very bad and worse than a government shutdown.

When do we hit the debt ceiling?

• Technically, we already did on August 1, but the Treasury has done some accounting wizardry to keep going. Janet Yellen is saying, “we’re going to be all out of ideas by October 18.”
• Right now, the federal debt is around 28.43 trillion. The current debt ceiling is 28.4 trillion. That is so much money, right? And often countries racking up debt will see people lose their faith in the countries. That’s what all money is about — am I confident that something backs this up? Do I believe you will repay your IOU with the interest you’re promising? Even though the US just keeps accumulating debt, we’re seeing our cost to borrow money falling. Investors still believe in the US economy and our country’s ability to make its interest payments.
• Raising the debt ceiling does not allow the government to spend more money. It is entirely about paying for programs and obligations that have already been committed to.

So…what is the problem?

• Democrats can’t raise the debt ceiling through ordinary legislation, because Republicans are filibustering it.
• Why? Just because.
• Just because. Because they don’t want to be associated with raising the debt ceiling, because they want to cut ads against Democrats for spending money and they are counting on the public not to understand what the debt ceiling means. I wish there were something I could say here that sounds less cynical, but…they are saying all of the quiet parts out loud and betting that everyone will be too confused to care.
• So Democrats have to raise the debt ceiling through reconciliation, and they don’t want to. Why? Because they don’t. It’s complicated, sure, but they could do it and they don’t want to. They are furious that they’ve cooperated on the debt ceiling under Republican controlled Senates with Republican presidents and aren’t getting the same courtesy.

What would minting a trillion dollar coin mean?

• How does this work? Minting the coin would not raise the debt ceiling. Only congress could do that. Minting the coin, proponents of this idea argue, would allow Treasury to keep spending money without additional borrowing.
• This idea has been around since 2011, when a blogger named Carlos Mucha writing as “beowulf” floated it as a debt ceiling work around.
• It is legal for the Secretary of the Treasury to issue platinum coins “in accordance with such specifications, designs, varieties, quantities, denominations, and inscriptions as the Secretary, in the Secretary’s discretion, may prescribe from time to time.” We probably have this provision so that the Secretary of the Treasury can celebrate certain people or events. But the law doesn’t restrict this power to just commemorations. — this has been legal since 1995 after a lobbying effort from coin collectors. Everyone has lobbyists!
• The US Mint already produces a one-ounce Platinum Eagle and could quickly change the mold to create a 1 trillion coin. The coin could then be deposited at the New York Fed via a quick helicopter rider.
• The trouble isn’t minting the coin. It’s spending it. Platinum coins are numismatic — they are rare and collectible . They’re investments, not actual money. They’re not meant to go into circulation. They’re made from valuable metals and are often sold for a higher value than they’re actually worth. So, is there a coin collector somewhere who is going to pay about $1 trillion for this platinum coin? I mean, I guess we shouldn’t rule it out but I’m not super comfortable with that as the direction for ensuring that the government continues to operate normally.
• Proponents think the that Federal Reserve could just purchase the coin from the Treasury, but the Federal Reserve doesn’t have authority to buy coins directly from the Treasury. It can only buy government bonds in the open market. That’s because the Federal Reserve isn’t supposed to issue money to finance government spending.
• Would minting a coin cause inflation? Proponents say no because it isn’t paying for new spending — it’s preserving the status quo spending that Congress has authorized. It’s just keeping up with debt obligations.

Where’s the administration on this?

• Jen Psaki said that the administration has looked at the option of minting a coin to avoid the debt limit but doesn’t see it as a viable option. The administration believes that congress must act.
• Janet Yellen said that’s a Gimmick that comprises the independence of the Federal Reserve and would damage trust in both Congress and the administration to pay the country’s bills. She says the Federal Reserve cannot just print money to cover deficits that Congress is unwilling to cover. It conflates monetary policy and fiscal policy.
• Paul Krugman is a proponent of minting a trillion dollar coin, even though he agrees with Janet Yellen that it’s a gimmick. His point is, is it a silly gimmick? Sure, who cares? The stakes here are really high and republicans aren’t even pretending to be serious legislative partners acting in the country’s best interest. He even says, it might be found to be illegal by a court. Who cares? It could buy some time.
• For some proponents, the gimmick is the point. You have a whole lot of people screaming from the rooftops that the economic policies we’ve been taking as gospel for a few decades are made up, and why not just show that they’re made up

What happens now?

• Some softening around the Republican position - Lindsay Graham said to Politico that he doesn’t want to put the nation’s credit at risk. “I mean, I’m not going to be a complete asshole about it. But I’m going to make them take some tough votes.”
• Potential to do a filibuster carve-out

On Friday’s episode of the podcast, we’ll be discussing Ronald Reagan’s legacy. I know that might seem kind of random, but Reagan’s presidency was transformative in ways that I have personally underappreciated and misunderstood. Preparing for that episode sent me down all kinds of paths. One of those paths was thinking more about social security, and that’s what I want to discuss today.

We have a new report to Congress telling us that social security’s long-term solvency is looking a bit bleaker than expected post-pandemic, and I want to think together about how the program works, what “solvency” for social security means, and how the last significant changes to social security took place during the Reagan administration.

Listen, everything is hard. We’re going to talk about Afghanistan and the Delta variant and more on abortion (sigh) on tomorrow’s podcast. Today, we’re going to indulge a little schadenfreude. A federal district judge in Michigan has brought the wrath to Lin Wood and Sidney Powell for lying in Court about the 2020 presidential election. It’s a good reminder 1) that some parts of our system hold; 2) that sometimes justice is served; and 3) that our friends and neighbors knee-deep in believing that the election was “stolen” have been heard, multiple times in multiple forums.

Hello my friends! This is Courtney for the Nightly Nuance. I was so honored to be chosen as one of the contributors for the summer infrastructure series. I am a farm wife and mother of four from central Illinois. Today I am sharing an area of infrastructure that is often overlooked, but very important to our overall economy and especially agriculture: inland waterways.

The infrastructure required for inland waterways involves locks and dams that allow barges and tugboats to pass through changes in elevation along waterways. It also includes dredging to remove silt from rivers to keep them deep enough for freight vessels to navigate.

Waterways are great at moving bulk freight long distances. They are very cost effective, fuel efficient, and environmentally friendly.  This makes them the preferred method for moving commodities like corn, wheat, and soybeans. Moving commodities via waterways is a major reason our grains are competitive in global markets.

Unfortunately, our locks and dams are in dire need of upgrades and replacements. Most of our locks were built in the 1930s and are currently 20 to 40 years past their design life. The American Society of Engineers gives our waterways a grade of D+ in their 2021 Infrastructure Report Card.

The first time the Supreme Court considered the ACA’s individual mandate (the requirement that we all have to buy some minimum level of health insurance or pay a fine), it upheld that mandate’s constitutionality because it imposed a tax (the penalty for non-payment). In 2017, the GOP repealed the penalty as part of the Tax Cuts and Jobs Act. So now we have a tax that doesn’t tax.

Thus, a group of states, led by Texas, took another shot at bringing the entire ACA down in Court. They argued:

• The individual mandate is only constitutional because it’s a tax
• It’s not a tax anymore
• Therefore it’s unconstitutional
• And it’s so important to the whole ACA, that the whole ACA has to come down with it.

Justice Breyer, joined by CJ Roberts and Justices Thomas (begrudgingly), Sotomayor, Kagan, Kavanaugh, and Barrett, find that they don’t have to reach these questions because the states don’t have standing to sue. They say the states haven’t been harmed by the individual mandate since 2017 because...again, there’s no penalty for violating it anymore. Case dismissed.

We know that Justice Thomas has begrudgingly agreed because he wrote a concurring opinion to tell us so.

And Justice Alito continues his verbosity with a long dissent (joined by Justice Gorsuch) about how the Court is once again just bending over backwards to save and unsaveable law.

I want to give you a little bit of a law-student-style outline of the legal issue here. We’re talking about the Sherman Act, which is intended to prevent unreasonable restrictions on trade. Determining what is so unreasonable that it’s illegal is hard, and courts aren’t excited to second-guess business decisions. The main thing we need to understand is that the Sherman Act is premised on the idea that competition is the best way to regulate a market. Typically, courts are going to use what’s called, unhelpfully, the “rule of reason” analysis, which has three steps:

1. The plaintiff (the person or group bringing the lawsuit) has to show that the defendant (the person or business or group being sued) is doing something that has a substantially anticompetitive effect.  Most lawsuits fail at this step. If the plaintiff can do this, then…
2. The defendant has to show that the activity the plaintiff is complaining about (the “challenged restraint”) is actually pro-competitive. If the defendant can do this, then…
3. The plaintiff has to show that whatever that pro-competitive benefit is, the defendant can reasonably achieve it in a way that is less of a burden on competition.

In this case, the Court ultimately finds that the NCAA’s restriction on compensation related to education is anticompetitive and unreasonable.

“Related to education” is an important qualifier. Justice Kavanaugh tells us he’s ready to go even bigger at stripping away the NCAA’s power to make money off student-athletes without paying them market value for their labor.

In Nigeria (the world's seventh most populous country with an emerging economy), the government has completely banned Twitter indefinitely. For everyone. For any reason. As in, reporters can't use Twitter to find or share news. As in, law enforcement is supposed to arrest people who tweet. 

If you have the kind of love/hate relationship that I have with Twitter (or perhaps you're more hate/hate or indifferent to it), this might not seem like the biggest deal to you. But, Twitter is where a ton of political activism and organizing takes place. Twitter is where lots of businesses make money. Twitter is where a lot of opportunity exists beyond your nation's borders. Twitter is where it's easiest to share what's happening at a protest in real time. Twitter is where comedy develops in its own language. A government deciding to shut down the entirety of that experience for over 200 million people to suppress dissent is a big deal.

Today, I’m talking about a federal judge’s decision to strike down California’s ban on assault weapons. My friend, Eric, who talked with me about guns and the Second Amendment on the podcast a while back, sent me a “Freedom!” gif from Braveheart, and he’d be very pleased with the Court’s analysis in this case. It’s kind of an unusual opinion -- almost like this judge has been sitting on big feelings about the gun regulation discussion for a long time and is letting it all out now.

His main points are:

• “Assault weapons” as a term doesn’t really mean anything.
• AR-15s and similar weapons are just modern rifles, and they’re really useful for both home protection and in warfare.
• The Second Amendment protects all guns that are commonly used for lawful purposes.
• People really, really like these guns.
• The Bill of Rights makes a policy choice: that guns in the hands of citizens are better than guns in the hands of people breaking the law. California’s legislature isn’t free to make a contrary policy choice.

I also think embedded in his opinion are 2 points that are the subject of just intractable discussion between my friends who are gun enthusiasts and me, both concerning human nature.

The comments to last week’s Nightly Nuance on gun ownership and freedom were so thoughtful and encouraging to read. Thank you for being a community that takes deliberations among citizens so seriously. (And I promise that my goal for next week is to have zero gun discussions).

I’ve been thinking about freedom a lot over the holiday weekend. Chad and I have argued a bit over the Chinese government’s restrictions on how many children families can have. I’ve gotten very riled up about building permits, speed traps, and HOA restrictions. All of this has made me realize, more deeply than I have before, that we don’t share a common definition of the most animating principle in our country.

When you think about freedom, it’s hard not to think about guns. Gun ownership symbolizes freedom for so many people, and the impact of guns deprives so many people of freedom.

I intended to talk about the NRA today, but my research led me in a different direction. The NRA seems to be slowly dying, and gun ownership is skyrocketing to the point of creating ammunition shortages.

How do we balance your peace of mind with mine, and is freedom in that balance? I look forward to you thinking with me about this today.

I don’t want to think or talk or write about Donald Trump, Bill Barr, even Bob Mueller ever again as long as I live.

And yet for 3 reasons, I find a recent order from US District Judge Amy Berman Jackson highly relevant to this question: may the government effectively lie to citizens and the courts about its deliberations and conceal the documents underlying those lies?

Judge Berman Jackson ordered that a memo about Barr’s decision to mischaracterize the Mueller report to Congress and the public be made public. And the Biden administration DOJ is fighting this order.

What a time to be alive.

For most of my life, the vast majority of crimes have been explainable on some level. Even after the worst terrorist attacks, we’ve pretty quickly understood who did it. We usually know something about why -- at least to the extent that we can ever understand each other’s motivations. I can’t recall a crime occurring in my life that we’ve not fairly quickly understood how it was done.

I think that’s why Havana Syndrome is so interesting to me. We know that since 2016, diplomats, CIA personnel, other government officials and their families working in Cuba, Uzbekistan, Russia, and China have experienced strange sickness: pounding headaches, dizziness, nausea, vertigo, ear pressure. They’ve sometimes heard strange piercing noises. Scientists who have observed these individuals find real neurological damage. At least one career CIA official had to retire early due to brain damage.

There are theories about what’s happening that range from “it’s an amalgamation of a bunch of different illnesses” to “this could be a sophisticated microwave weapon secretly developed by the Russian GRU.” There are suspicions that the Chinese government could be behind these attacks. We just don’t know.

Congress is fed up with “we just don’t know,” especially after years of extreme secrecy and poor interagency coordination during the Trump administration. Hopefully, we’ll have more answers soon. -beth

P.S. On the topic of things-we-don’t-understand, I’m waiting with baited breath for the UAP report expected next month. We will definitely be talking UFOs then!

Today, let's talk about Alabama's law allowing yoga to be taught in schools for the first time since 1993. Alabama Representative Jeremy Gray (who is a Democrat, a former football player, and a registered yoga teacher) has tried twice before to lift Alabama's ban on yoga, and succeeded on this third go. 

In order to pass the law through Alabama's Republican-dominated legislature, the law contains some truly ignorant and offensive language. I think the controversial aspects of teaching yoga in American schools offers a chance to think deeply about the yoga industry and the way that Americans engage with yoga, especially as India is suffering so enormously from the pandemic. 

Because I have a strong personal connection with yoga, I begin this Nightly Nuance with a bit of my personal story. It feels important to me to disclose the strong biases and influences that I have around yoga and to admit to you that I don't always ask the right questions or find the right answers. I'm always living in the tension of truly loving yoga, trying to understand it more deeply, and knowing that I'm experiencing it in ways that are problematic.

The risks are not insubstantial! The Census discovered that just about anyone could analyze data from the 2010 Census, compare it to publicly available information, and trace individual responses back to about 53 million people. YIKES. So, the Census is using a technique called differential privacy--introducing “noise” into the data to try to protect individual responses without compromising the statistical conclusions drawn from the data. And this approach has sparked controversy.

There is good news and bad news. Let’s start with the good news: the government is making great strides in reducing the number of children who are in law enforcement custody. The Federal Emergency Management Association has stepped in to help transition kids from Customs and Border Patrol custody to care from the Department of Health and Human Services.

The bad news: HHS is not equipped to handle this many children and is building Emergency Intake Sites where kids are housed in unsuitable positions for too long. The communication with family members in the US who can sponsor children has been poor. There are allegations of abuse and neglect within these facilities.

Today, I want to think about why the federal government is so poorly positioned to care for kids and reunite them with families and what that might mean for future policy efforts.

There is no easy way to talk about this. There is nothing simple about it. I think the most important thing to remember is that so many people in this region just want to live a normal life. They didn’t choose this. They have varying degrees of confidence in the leaders who launch rockets and deploy aggressive police forces.

I’m picking up today from my 2016 primer on this subject. If you haven’t listened or need a refresher, check it out.

If we think of the generations-long struggle in this region as a fire that’s always burning to some degree, there are many factors that are causing it to rage right now, including:

• Political turmoil in both Israel and Palestine
• Attempts to evict Palestinians from the Sheikh Jarrah neighborhood
• The presence and aggression of police forces at Temple Mount
• Hamas issuing an ultimatum to Israel
• The convergence of clashes and events during Ramadan and the celebration of Jerusalem Day
